Acceptance of Terms

By accessing or using ASCII ART at https://asciiart.app/ (the "Service"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and AsciiArt.App ("we," "us," or "our").

Description of Service

ASCII ART provides an online ASCII art generation platform that allows users to:

• Convert images (JPG, PNG, GIF, WebP, etc.) to ASCII art.
• Generate text-based ASCII art from custom text inputs.
• Convert video files or segments to animated ASCII art.
• Generate images using AI and immediately convert them to ASCII art.
• Download, copy, and share the resulting ASCII art output.

We may modify, suspend, or discontinue any part of the Service at any time. Where possible, we will provide reasonable advance notice of significant changes.

User Accounts

To access certain features (saving creations, managing credits, subscriptions), you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Ensuring the accuracy of your account information.

Notify us immediately at support@asciiart.app if you suspect any unauthorized use of your account or any security breach.

AI-Generated Content Policy

ASCII ART offers AI image generation as an optional feature. When using AI generation tools, you agree to the following:

Prohibited Content

You must not use the Service to generate, upload, or create content that falls into any of the following categories:

1. Sexual or NSFW Content — Nudity, sexually suggestive imagery, or pornographic material.
2. Violence or Gore — Graphic depictions of violence, blood, gore, or disturbing injury-related imagery.
3. Hate Speech — Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
4. Child Safety Violations — Any content that exploits, harms, or depicts minors in unsafe, exploitative, or illegal contexts, including Child Sexual Abuse Material (CSAM).
5. Deepfakes or Impersonation — Content designed to falsely impersonate real individuals, create deceptive political material, or manipulate identity with the intent to deceive or defraud.
6. Copyright or Trademark Infringement — Content that unlawfully reproduces, distributes, or exploits copyrighted material, trademarks, or other intellectual property without proper authorization.

Content Moderation

We employ a combination of automated screening and human review to detect policy violations:

• Automated Filtering: All AI-generated outputs pass through our content safety filters before delivery. Prompts that clearly violate these policies are rejected before generation begins.
• Post-Generation Review: We may periodically review user-generated content for compliance. Content flagged by automated systems is queued for manual review.
• Cooperation with Authorities: We cooperate fully with law enforcement and regulatory bodies in cases involving illegal content, including CSAM or threats to public safety.

User Reporting

If you encounter content that violates these policies, please report it immediately:

• Include a description of the content, any relevant URLs, and why you believe it violates these policies.
• We will review reports within 24 hours during business days and take appropriate action.

Enforcement Actions

Violations of this policy may result in:

• Content Removal: Any content found to violate these policies will be removed from the Service.
• Account Suspension: Repeated or severe violations may result in temporary suspension of your account, during which you cannot access the Service.
• Account Termination: Persistent violations, especially involving illegal content, may result in permanent account termination with no refund of credits or subscription fees.
• Legal Action: In cases involving illegal activity (e.g., CSAM, copyright infringement), we reserve the right to report the violation to relevant authorities and pursue legal remedies.

We reserve the right to modify this policy at any time. Continued use of the Service constitutes acceptance of any changes.

Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree not to:

• Upload, submit, or generate content that is illegal, obscene, defamatory, threatening, harassing, or that infringes upon any third party's rights.
• Upload images, videos, or text containing content that violates applicable laws (including copyright, privacy, and export control laws).
• Attempt to gain unauthorized access to our systems, servers, networks, or databases.
• Use automated tools, bots, or scrapers to access the Service in a manner that places unreasonable load on our infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with or disrupt the integrity, security, or performance of the Service.
• Use the Service to generate content that could deceive others (e.g., fake identity documents rendered as ASCII art).
• Resell, sublicense, or commercially exploit the Service without our prior written consent.

We reserve the right to investigate and take appropriate action against any violations of this section, including removing content and terminating accounts.

Intellectual Property

Our Content

The Service, including its design, software, features, algorithms, branding, and documentation, is owned by AsciiArt.App and is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, reproduce, modify, or create derivative works of our proprietary materials without our explicit written permission.

Your Content

You retain ownership of the images, videos, and text you upload to the Service ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free license to process Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or your account.

ASCII Art Output

The ASCII art generated from Your Content belongs to you. You are free to use, share, and publish your generated ASCII art for personal or commercial purposes, subject to any rights held by the original content's owner (e.g., if you upload a copyrighted image).

Credits and Subscriptions

Free Tier

The Service offers a free tier with limited monthly credits for generating ASCII art. Free tier limits and features are subject to change.

Paid Plans and Credits

• Subscriptions are billed in advance on a recurring basis (monthly or annually) for the selected plan.
• Credits may be purchased as one-time top-ups for use with premium features such as AI image generation and video conversion.
• You are responsible for providing accurate and up-to-date billing information.
• All prices are displayed in USD (or the currency applicable to your region) and include applicable taxes where required by law.

Refunds

We offer refunds on unused credits or subscription fees on a case-by-case basis at our discretion. To request a refund, please contact support@asciiart.app within 14 days of the charge.

User-Generated Content and Community

If the Service includes any public sharing or gallery features, you agree not to post or share content that violates these Terms. We reserve the right to remove any content we determine, at our sole discretion, to be in violation of these Terms or otherwise harmful.

Third-Party Services

The Service may integrate with or link to third-party services (e.g., payment processors, authentication providers, analytics tools). We are not responsible for the privacy practices or content of those third-party services. Your use of such services is governed by their own terms and policies.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, AsciiArt.App and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $10.

Governing Law and Disputes

These Terms are governed by applicable law, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration or the appropriate courts as required by applicable law.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this page and, where appropriate, sending a notice through the Service or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service ceases immediately.
• Unused credits are non-refundable unless otherwise required by law.
• Provisions that by their nature should survive termination will remain in effect (including intellectual property, disclaimer, limitation of liability, and governing law).

You may close your account at any time through your account settings.
